Victims of Human Trafficking

To comply with our obligations as set forth by the Fair Credit Reporting Act (FCRA), and in an effort to assist any individual who has been a victim of human trafficking, the following process is used to block items of information that were the result of being a victim of human trafficking.

How to submit a request

The FCRA requires that any person wishing to block information that was the result of being a victim of human trafficking submit a request. You may craft your own individual request or you may use this sample letter from the Consumer Financial Protection Bureau.

Step 1) Please Provide Proof of Identity

To satisfy proof of identity, you may provide copies of a government-issued ID, driver’s license, birth certificate, passport, or Social Security card.

Step 2) Trafficking Documentation

As a consumer who is a victim of trafficking, you are required to provide Trafficking Documentation, which includes victim determination and identified adverse items of information.

A) Victim Determination

You are required to provide documentation of a determination that you are a victim of trafficking, made by either:

  • a Federal, State, or Tribal governmental entity,
  • a court of competent jurisdiction, which includes certain documents filed in court;
  • a non-governmental organization or human trafficking task force, including victim service providers affiliated with these entities, authorized by a Federal, State, or Tribal government entity; or
  • a self-attestation by a consumer who identifies as a victim of trafficking that is signed or certified by a Federal, State, or Tribal government entity, court of competent jurisdiction, or an authorized representative of these entities.

B) Identified Adverse Items of Information

In order to have a block placed on adverse information in your consumer report, you are required to identify the specific items of adverse information that should not be furnished by a consumer reporting agency because the items resulted from a severe form of trafficking in persons or sex trafficking.

NOTE: Once your request has been received by PreTrax:

  1. PreTrax will initiate a block of the relevant information within four (4) days of receipt of your request.
  2. PreTrax will notify you within five (5) days if any additional information is required.
  3. PreTrax has twenty-five (25) days to make a final determination on your request.
  4. You will be notified within five (5) days that a final determination has been made regarding your request.
